Between 1939 and 1955, the United States of America acquired 1,399.94 acres fee and easements over 163.39 acres to establish Stewart Field which later became Stewart AFB. There is a... see more » Between 1939 and 1955, the United States of America acquired 1,399.94 acres fee and easements over 163.39 acres to establish Stewart Field which later became Stewart AFB. The site was acquired by condemnation, purchase and donation. There is a discrepancy of 17.48 acres, an accurate survey was done at the time of disposal, so the U.S. actually acquired 1,917.42 acres instead of 1,899.94 acres. The site was initially used by the Army Air Corps and was known as Stewart Field. In 1947, the site was transferred to the Air Force as an AFB, and the name was changed to Stewart AFB. The U.S. built runways, hangers, control towers, family housing units, barracks, command buildings, maintenance shops and all related ancillary buildings. In June 1970, Stewart AFB was excessed to the General Services Administration (GSA) for disposal. By quitclaim deed dated 26 July 1959, 24.671 acres in easements were conveyed to Louis H. Breitenbach, as administrator, C.T.A of the Estate of Henry J. Breitenbach. This deed excepted easements over 7.47 acres which were retained by the State of New York. By deed dated 13 March 1974, 7.90 acres in fee were conveyed to the Metropolitan Transit Authority (MTA). By transfers dated 30 June 1971, 30 May 1972 and 8 January 1973, 320.30 acres were transferred to the Department of the Army. Based on the 1989 FDE, the Army still owns this acreage, which is under the jurisdiction of West Point. By quitclaim deed dated 16 October 1970, 1,589.22 acres in fee, and easements over 133.32 acres, were conveyed to the MTA. The deed restricted use to public airport purposes and contained a recapture clause. There was a provision requiring the grantee to keep and maintain the land and improvements for the use and benefit of the public as an airport, with the Federal Aviation Administrator having the authority to determine the useful life of any structure.
