Fort Lafayette was granted to the War Department, predecessor to the DOD, by Acts of the State Legislature of the State of New York dated 30 March 1807 and 18 March 1808. Fort Lafayette consisted of 9.7 acres fee of which 7.2 acres were underwater... see more » Fort Lafayette was granted to the War Department, predecessor to the DOD, by Acts of the State Legislature of the State of New York dated 30 March 1807 and 18 March 1808. Fort Lafayette consisted of 9.7 acres fee of which 7.2 acres were underwater lands and 2.5 acres, the actual island. A sizeable stone fortification was built on the island during the War of 1812. During the Civil War, Fort Lafayette was used as an internment camp for rebel soldiers and southern sympathizers. By an outgrant dated 15 August 1957, the Department of the Navy granted the Tri-Borough Bridge and Tunnel Authority ("TBTA") a perpetual easement for a right-of-way at Fort Lafayette. On 1 September 1960, The Department of the Navy declared Fort Lafayette as excess property. Subsequently, on 29 September 1960, GSA, acting as disposal agency for The Department of the Navy, reported Fort Lafayette as surplus property under the provisions of GSA Reg. 2-V-201 .03. On 21 July 1961 Fort Lafayette was transferred to the State of New York as a donation, pursuant to Section 202(h) of the Federal Property & Administrative Services (FP&AS) Act of 1949.
