1. Robert Montague,M.D., v. Sec?y of Dept. of HHS, Case No. 16-298V before the U.S. Court of Federal Claims under the National Vaccine Injury Compensation Act. I represent petitioner, Dr. Montague. Dr. Montague is pursuing no-fault compensation for a vaccine related injury, specifically brachial neuritis following a tetanus-diptheria vaccination. This vaccine-injury combination is an accepted vaccine-caused injury under this program as long as the injury occurred in 2-28 days after the vaccination and there?s no other apparent cause. Because of a couple issues in the medical records, one in particular that my client claims is an error regarding onset of his symptoms, the government argues the injury may have pre-dated Dr. Montague?s vaccination. I would like Dr. Wright to address a second issue regarding the timing of the injury though, the interpretation of Dr. Montague?s EMG/NCS and the interpreting physician?s statement that abnormalities were from ?old damage.? I?d also like to discuss with Dr. Wright the typical progression and timing of muscle atrophy in brachial neuritis. I do not require any sort of general opinion that the vaccine caused this injury. 2. I?m not sure the entire records needs review but if Dr. Wright prefers that, there are only 150 pages total of records and affidavits. 3. I would like review, and a report if he has a supportive opinion on the EMG, in the next two to three months. However, there is no court deadline presently, so we have flexibility.
This review will take place at my home on personal time.
