Issue:

Birmingham VA Medical Center (BVAMC) Privacy Officer (PO) received a report of contact (ROC) from a provider in the audiology department at the BVAMC that a BVAMC employee stated she was the daughter of a patient being seen at the audiology clinic and the employee asked to accompany the patient during a hearing test. The provider denied the employee's request due to limited space. The employee asked the provider to contact her after the testing so that she could accompany the patient to hear the results of the testing. Provider asked the patient if he would like for his daughter to be contacted to hear the results of the testing. Patient informed provider that the employee is not his daughter, but a close family friend and that he did not want her to be contacted or to be present while provider was going over the test results. On 1/13/2014, provider received a voicemail from the employee stating there was a problem with the patient's hearing aids and wrote a note in the patient's chart and asked the provider to sign off on the note. BVAMC Privacy Officer is conducting an investigation into this matter.

Outcome:

01/17/14: The Veteran will receive a HIPAA letter of notification.
