Issue:
Based on interview and record review, the hospital failed to notify the California Department of Public Health within five business days of discovering that a breach of Patient HB's medical information had occurred.Findings:In an interview on 10/7/14 at approximately 2:15 PM, the hospital's Privacy Analyst (PA 1) stated that on 8/21/14, a laboratory requisition for future tests was handed to another recipient rather than to Patient HB. When the other recipient read the requisition, he realized he had received it in error and on 8/26/14, he notified the clinic Manager of the error. PA 1 stated that the reporting delay occurred because the Clinic Manager, or designee, failed to notify the hospital's Privacy Office in a timely manner.Record review indicated the laboratory requisition contained the following protected health information: Patient HB's name, medical record number, date of birth, sex, date of service, tests to be performed, clinic name, and physician name.Record review indicated a fax, dated 9/11/14, notifying the California Department of Public Health (CDPH) of this breach, which was eight (8) days after the five business day grace period had ended. Record review indicated a copy of a letter, dated 9/11/14, sent to Patient HB notifying him/her of this breach of his/her medical information.The hospital was eight (8) days late in notifying CDPH and Patient HB of the breach of HB's protected health information.
