Issue:

Based on interview and documents review, the facility failed, for one patient (Patient A), to ensure that Protected Health Information (PHI) was not disclosed to an entity not authorized to receive the information. Findings:On March 12, 2012, an investigation regarding unauthorized disclosure of Patient A's PHI was conducted. On May 15, 2013, at 10:06 a.m., a follow up phone call was made to the facility. A phone interview with the Executive Secretary (ES) was conducted. The ES stated on February 21, 2012, Patient B was in the Emergency Department (ED). During the registration process, an employee of the Admitting Department accidentally selected Patient A's name in the computer. An arm band was made with Patient A's name, date of birth, and medical record number on it. When the ED staff checked the identifier on arm band with Patient B, they noticed Patient B had an arm band with Patient A's information on it. Patient B then sent back to the Admitting Department for a correct arm band. The arm band with Patient A's information was shredded afterwards. On May 15, 2013, a review of facility documents included:a. A letter addressed to Patient A, dated February 28, 2012, indicated the facility notified Patient A of the privacy breach.
