Issue:
Based on interview and record review, the hospital failed to notify Patient 1 within five business days of the disclosure of Protected Health Information (PHI), when a form containing Patient 1's PHI was inadvertently faxed to the wrong physician's office. The hospital was notified of the disclosure on 12/2/13 and reported the disclosure to Patient 1 on 12/13/13. The failure resulted in non-compliance of Health & Safety Code 1280.15(b)(1). Findings:The California Department of Public Health received a faxed report on 12/13/13, which indicated on 12/2/13 the hospital was notified of PHI faxed incorrectly to the wrong physician's office. Patient 1 was notified on 12/13/13 of the unauthorized disclosure of PHI.During an interview on 12/17/14 at 11:30 a.m., the compliance and privacy officer and the ethics and compliance officer both acknowledged the hospital was aware of the unauthorized disclosure of PHI on 12/2/13, and this was reported to Patient 1 on 12/13/13.
