Issue:

On 5/01/13, the Community Based Outpatient Clinic (CBOC) Administrative Officer (AO) informed the Privacy Officer (PO) that Veteran B provided her with a letter received by mail for Veteran A. It contained Veteran As full name, address (no SSN), and recent lab results, dated 3/13/13. The lab results were collected on 3/11/13. Veteran B reports that he received his own VA letter in a window envelope, unknown date. However, he discovered that the last page belonged to Veteran A. Document recovered will be provided to PO to resend to Veteran A. Further notification and investigation, pending.

Outcome:

05/01/13: Veteran A will receive a HIPAA letter of notification. 06/05/13: This was determined to be HITECH reportable by VHA Privacy Office.
