Issue:

Based on interview and documents review, the facility failed, for one patient (Patient A), to ensure that Protected Health Information (PHI) were not disclosed to an entity not authorized to receive the information. Findings:On February 4, 2013, at 3 p.m., the facility's Compliance Specialist (CS) was interviewed by phone. The CS stated on January 15, 2013, the facility was informed by a staff from the outpatient laboratory that Patient A's mammogram report was faxed to them incorrectly. The outpatient laboratory staff faxed the report back to the facility and shredded the report which they received. The CS stated Patient A was informed of the unauthorized disclosure of her PHI by letter on January 21, 2013. On February 4, 2013, a review of facility documents included:a. Patient A's mammogram report. The PHI included Patient's name, date of birth, age, phone number, and the result of the mammogram. b. A letters addressed to Patient A, dated January 21, 2013, indicated the facility notified Patient A of the privacy breach.
