Issue:
A routine Sensitive Patient Access Report (SPAR) indicated a potential unauthorized access to deceased Veteran employee's medical record. This affected 1 deceased Veteran. Data elements include full SSN, home address, home phone, and protected health information (PHI). The investigation is continuing to determine if there was a compelling business need for employee access to this record. Update: 11/30/11:The Privacy Officer (PO) concluded the investigation, and determined that 9 employees inappropriately accessed the medical record. The deceased Veteran employee's family wil;l receive a next of kin letter.
Outcome:
Recommended Administrative Action and all employees re-take privacy training. I have already conducted focused privacy training with these employees.
