Issue:

Based on interview and record review, the facility failed to ensure the PHI (protected health information) of Patient A remained confidential. This failure resulted in the unauthorized disclosure of Patient A's PHI to an unintended recipient in the community.Findings:An interview was conducted with the Director of Facility Operations/Compliance on March 19, 2015, at 11:30 a.m. The Director stated on January 29, 2015, Patient A had a procedure in the facility's same day surgery department. The Director stated following Patient A's surgical procedure an employee handed Patient A's post surgery discharge instructions to another patient.The Director further stated the unintended recipient gave the discharge instructions to a family member, who returned the PHI to the facility on February 25, 2015. A review of Patient A's PHI which was disclosed was conducted. The PHI reflected Patient A's name, medical record and account numbers, the date of the service, and a description of the surgical procedure performed.A review of the facility's policy, "Information Privacy (Reviewed 02/13/2015)," was conducted. The policy indicated, the facility will take all necessary steps to avoid unauthorized or unlawful access, use or disclosure of PHI and to mitigate any harmful effect that is known.
