Issue:

Today, 11/20/14, a Veteran employee filed a privacy complaint after receiving his Sensitive Patient Access Report (SPAR) yesterday. The Veteran highlighted fifty-five staff names on the SPAR report. She believes staff accessed her medical record without her authorization or a business need to perform services on her behalf. The Privacy Officer (PO) will clarify her complaint further with Veteran-employee. Veteran had called the office previously indicating she did not feel safe now after this but did not file a complaint. She was advised to contact her manager or management within chain of command STAT for these concerns. Additional notification and investigation, to ensue.

Outcome:

04/30/15: The Incident Resolution Service Team has determined that the Veteran/employee will be sent a HIPAA notification letter due to Protected Health Information (PHI) being accessed inappropriately.
