Issue:
Based on interview and record review, the hospital failed to ensure that Patient 1's confidentiality of their protected health information (PHI) was maintained. Findings:An interview with the Privacy Officer (PO) was conducted on 2/15/12 at 3:20 P.M. The PO stated that an emergency department (ED) clerk incorrectly read the fax number and faxed Patient 1's medical records to the wrong fax number. The medical records that were inadvertently faxed to the wrong fax number indicated Patient 1's name, medical record number, diagnoses, radiology results, and past medical history.An interview with the ED Manager (EDM) and Clinical Manager (CM) was conducted on 2/15/12 at 4:45 P.M. The CM stated that the clerk should have called the receiving hospital to verify that their fax number was correct before faxing the patient's medical records.
