Issue:
Based on interview and record review, the facility failed to ensure staff did not give prescriptions for Patient A to Patient B. This failure resulted in the unauthorized disclosure of Patient A's protected health information (PHI), which created the potential for unauthorized use.Findings:On August 3, 2012, at 11:45 a.m., the Compliance Specialist was interviewed via telephone, concerning a breach of PHI. The Specialist stated the Compliance Department was notified on May 14, 2012, of the breach of PHI. Patient B was discharged from the Emergency Department (ED), on May 6, 2012. Patient B was given discharge prescriptions for Patient A. The prescription contained Patient A's name, address, and medications.On August 3, 2012, the undated facility policy and procedure titled, "HIPAA (Health Insurance Portability and Accountability Act) - Use and Disclosure of Protected Health Information", was reviewed. The policy indicated, "...Policy It is the policy of (name of facility) that the confidentiality of Protected Health Information contained in records and collected pursuant to treatment will be protected to the fullest extent possible..."
