Issue:

Based on interview and record review, the facility failed to ensure the PHI (protected health information) of 19 hospice (terminally ill) patients remained confidential This failure resulted in the unauthorized disclosure of PHI.Findings:An interview was conducted with with the facility's Privacy Officer on November 27, 2012, at 3 p.m. The Privacy Officer stated on October 11, 2012, the Social Worker's trunk was broken into and a notebook taken which contained referrals and the initial plans of care for 19 hospice patients.The PHI reflected in these documents included each patient's name, date of birth, social security number, address, insurance information, emergency contact number, phone number, diagnoses, medical history, their physician's name in addition to the social work and nursing initial plans of care.A review of the facility's policy, "Information Management (Date Reviewed: 05/12) Subsection: HIPAA (Health Information Portability and Accountability Act)," indicated the facility is to comply with applicable federal and state laws that protect the privacy and security of patients' health information.
