Issue:
Based on interview and record review, the facility failed to ensure there was unauthorized access to 10 patients' medical records when a Licensed Vocational Nurse (LVN 1) working in the Emergency Department, accessed 10 patients' medical records in other areas of the facility and obtain Dilaudid from the Pixus system (a medication dispensing machine) for herself.Findings:On May 3, 2013, a visit was made to the facility for the purpose of investigation an entity reported occurrence. During an interview with the facility's Medical Center Compliance Officer (MCCO), she stated, on April 12, 2013, a Registered Nurse (RN) working unit 3 West got into the Pixus and found that a Dilaudid dose for her patient was taken from the ED. The RN reported drug diversion to the pharmacist who then conducted further audits. The pharmacist was able to find 10 medical records that LVN 1 accessed, and was able to view the patients' name, medical record numbers and the patients' medications.A review of the facility's documents, breach notification letters were sent to the 10 affected patients.Further interview with the facility's MCCO, she stated LVN I was placed on investigation and will be terminated. The incident was reported to the LVN Board and to Law Enforcement.
