Issue:
Based on interview and record review, the facility failed to ensure the protected health information (PHI) of Patient A remained confidential. This failure led to the unauthorized disclosure of Patient A's PHI to Patient B, who was not authorized to receive the information.Findings:An interview was conducted with the Director of Accreditation, Regulation and Licensing on December 12, 2013, at 3:30 p.m. The Director stated Patients A and B were discharged on the same day from the Post Anesthesia Care Unit. Patient B subsequently notified the facility that he was given the FACE sheet (a document which reflects patient demographics and PHI) which belonged to Patient A.A review of Patient A's FACE sheet was conducted. The document reflected Patient A's name, address, phone number, emergency contact information, patient identification and hospital account numbers, and the patient's diagnosisA review of the facility policy, "Mitigation of Impermissible Uses and Disclosures of Protected Health Information (Revision Effective: September 23, 2013)," was conducted. The policy indicated, "(the facility) must take action to reduce or eliminate, to the extent feasible, any known compromise caused by an impermissible use of disclosure of Protected Health Information..."
