Issue:

Based on interview and document review, the hospital failed to maintain the confidentiality of Patient F's protected health information (PHI). In addition, the hospital failed to report the disclosure of Patient F's PHI within five business days of the hospital's knowledge of the breach to the patient and to the Department.Findings:On 8/5/11, the hospital was informed a breach of Patient F's PHI occurred on 8/2/11 at 1130 hours.The hospital investigation showed a staff member received the fax number of the physician's office in order to send an order form to be signed by the physician. However, an unintended recipient, the admitting department of another acute care hospital, called regarding the misdirected fax and informed them of the fax error.The PHI belonging to Patient F disclosed the patient's name, physician, medication and an order for a procedure/test to be done.On 5/22/12 at 1500 hours, a telephone interview with the Hospital Compliance and Privacy Officer occurred. He stated he was aware of the incident on 8/5/11; however, he did not believe it was a reportable event. After discussing the incident on 8/22/11, with his superior both decided it was a breach and was reportable. The hospital did not report the breach to the patient or to the Department until 8/22/11.
