Issue:

Based on interview and record review, the facility failed to notify the California Department of Public Health (CDPH) of the breach of personal patient health information within the required five business days after discovery.Findings:During an interview on 11/22/13 at 3:30 PM, Privacy Analyst stated patient's medical information, progress note including name, date of birth, admitting diagnosis, lab results, and physical exam was inadvertently faxed on 10/4/13 at 4:26 PM to an incorrect health care practitioner (dentist) .Record review indicated a letter, dated 10/21/13, notifying the California Department of Public Health of the breach in patient's protected health information. In the letter, the facility stated they were notified of the event on 10/10/13. The facility was four days late in notifying CDPH after the five day grace period had ended.
