Issue:
Based on interview and record review, the facility failed to ensure for one patient (Patient A), that her protected health information (PHI) was not disclosed to an entity not authorized to receive the information, by faxing Patient A's PHI to the wrong physician's office. This failure resulted in unauthorized access of Patient A's PHI.Findings:An interview was conducted with the Information Privacy Officer (IPO) on April 18, 2014, at 1:30 p.m. The IPO stated on March 25, 2014, a staff member (Staff 1) had entered Patient A's demographic information into the facility's computer system, however, Staff 1 listed the wrong primary care physician for Patient A in the computer. The IPO stated Patient A had an x-ray procedure done on March 25, 2014, and another staff (Staff 2) sent the results of that x-ray along with Patient A's demographic information to the incorrect physician's office due to the incorrect information in the computer system.The IPO further stated the following PHI for Patient A was disclosed to the incorrect physician's office:a. Nameb. Date of birthc. Medical record numberd. Addresse. Phone numberf. Hospital account numberg. Mammogram screening report (x-ray of the breast)The facility's policy and procedure titled "HIPAA - (Health Information Portability And Accountability Act) Use And Disclosure Of Protected Health Information," revised November 18, 2014, was reviewed. The facility's policy was "To protect the patient's rights to privacy and confidentiality, at no time will names or information be shared with any person who does not have a need to know in order to provide patient care. All personnel should refrain from discussing the patient's presence, illness, treatment, prognosis, or condition with any individual not directly associated with the care of the patient . . ."
