Based on interview, and record review, the facility failed to ensure confidential treatment of Patient A's Protected Health Information (PHI), when a document of Patient A had inadvertently been given to Patient B, following an appointment at the main health facility.During a phone interview with the facility Complaint Specialist (CS), on June 30, 2015, at 11:45 AM, the CS stated the incident had occurred at the behavioral health unit of the facility. The information that had been disclosed contained the following: Patient A's name, medical record number, date of birth, address, phone number, date of treatment, admitting diagnosis, insurance provider and insurance subscriber number.The CS stated on October 30, 2014, the health facility was notified by Patient B, stating he had received Patient A's PHI, following an appointment at the health facility. Patient B realized he had received the document in error, and he returned it to the health facility. He also provided a statement indicating none of the information had been retained. In review of the documents provided to the Department, on November 5, 2014, a letter of notification was sent to Patient A, informing of the inadvertent disclosure of protected health information. The facility policy and procedure titled, "Patient Rights-Protection of Patient Privacy," dated August, 2013, indicated the following: "All [name of facility] employees...shall be responsible for maintaining the confidentiality of patient information..."The facility policy and procedure titled, "Privacy and Security of Information Resources-Information Classification and Protection" dated August, 2011, indicated "...Confidential information shall include, but not be limited to: a. All Protected Health Information (PHI)...1. Protecting and protection of confidential information, including PHI, is of critical importance and shall be protected according to the requirements of Policy BP-16, Protection of Patient Privacy." .
