Issue:

Based on interview and record review, the facility failed to prevent unauthorized disclosure of protected health information (PHI) for one patient (Patient 1). An employee gave Patient 1's prescription and discharge instructions to another patient. This failure resulted in an unauthorized person having access to Patient 1's PHI and the potential misuse of the information.Findings:On February 19, 2015, at 2:30 p.m., the Privacy Officer (PO) was interviewed. The PO stated, "On February 6, 2015, there were two pediatric patients in the Emergency Department (ED) at the same time. Registered Nurse (RN) 1 gave Patient 1's prescription and discharge instructions to Patient 2's mother at the time of discharge.The PO stated, RN 1 realized the error right away, but Patient 2 had already left the ED. RN 1 called Patient 2's mother to explain the error and requested for her to return the paperwork and prescription to the facility, which she did. The PO stated the employee (RN 1) should have double checked all discharge paperwork, including the prescription, to ensure it was being given to the correct patient.A copy of Patient 1's prescription and discharge paperwork was reviewed, and contained the following PHI:- Name;- Address;- Date of Birth;- Medical record number;- Account number; - Diagnosis; and- Medication prescribed.
