Issue:

Based on interview and record review, the facility filed to ensure the PHI (protected health information) of Patients A, B, C, D, E and F remained confidential. This failure resulted in the unauthorized disclosure of Patients A, B, C, D, E and F's PHI to an unintended recipient.Findings:An interview was conducted with the facility's Administrative Services Officer (ASO), on April 1, 2014, at 10 a.m. The ASO stated a social worker at the facility faxed physical therapy referral information for Patient G, and in the process also faxed PHI of Patients A, B, C, D, E and F's PHI. A review of Patients A, B, C, D, E and F's PHI was conducted on April 1, 2014. The PHI reflected each patient's name, medical record numbers, account numbers, date of birth and physical therapy progress notes.A review of the facility policy, "Facsimile Transmissions (Release Date: 10/25/2012)," was conducted. The policy indicated the goal was "To protect the confidentiality and integrity of individually identifiable health information faxed to or from the facility, providers, or practitioners."
