Issue:

Patient Representative was contacted by a Veteran with the complaint that her boyfriend had accessed her medical records without a need to know. She shared information regarding a medication change that he would have only known if in her medical record Update: 09/08/11:According to the Privacy Officer, a fact finding report has revealed that employee did access girlfriend's record. Therefore Veteran A will be sent a letter offering credit protection services.NOTE: There were a total of 17 Mis-Handling incidents this reporting period. Because of repetition, the other 15 are not included in this report, but are included in the "Mis-Handling Incidents" count at the end of this report. In all incidents, Veterans will receive a notification letter and/or credit monitoring will be offered if appropriate.

Outcome:

Appropriate actions taken with employee - he did acknowledge he had accessed record without a need to perform his job. Initially the Veteran's record was not marked as sensitive - it is now.
