Issue:
An RN discussed a Veteran's protected health information with his spouse. The RN did not have authorization, power attorney or legal documents to do so. Update: 04/23/13:The addendum note by the nurse states she was told by Veteran's spouse the Veteran was not available. The original progress note that this addendum was added to has documentation by the staff psychologist there is partner relationship problems. Additional addendum added on 04/12/2013 Veteran states to nurse "spouse is always messing in my meds." This documentation was done by the same nurse. The Veteran will receive a HIPAA letter of notification.05/16/13:This was determined to be non-HITECH reportable by VHA Privacy Office.
Outcome:
The employee took privacy training again. The PO provided training to primary care nursing staff on 04.24.2013.
