Issue:
Based on interview and record review, the facility failed to ensure the PHI (protected health information) of Patient A remained confidential. This failure resulted in the unauthorized disclosure of Patient A's name, diagnosis, phone number, insurance information, next of kin and emergency contact information to an unintended insurance provider.Findings:An interview was conducted with the facility's Compliance Specialist (CS) on September 18, 2013, at 11 a.m. The CS stated an admitting clerk in the emergency department faxed insurance information to an unintended insurance provider.A review of Patient A's PHI which was faxed to the unintended insurance provider was conducted. Items faxed included Patient A's name, diagnosis, phone number, insurance information, next of kin and emergency contact information.A review of the facility policy, "Faxing Protected Health Information (Last Reviewed/Revised 03/21/2013)," indicated, "All Protected Health Information sent or received by (the facility) shall be in a manner that protects against unauthorized disclosure of such records to third parties..."
