Issue:

Based on interview and record review, the facility failed to ensure PHI was not disclosed to a person or persons who were not authorized to receive it when a physician handed the lab slip for one patient (Patient 1) to a different patient (Patient 2). This failed practice resulted in the potential for physical, emotional, and financial harm to Patient 1.Findings:During an interview with the facility Legal Assistant on July 23, 2013, at 2 p.m., the assistant stated on May 24, 2012, a physician in an outpatient clinic handed the lab slip for one patient (Patient 1) to a different patient (Patient 2). She stated the two patients were in the clinic at the same time being seen by different physicians, and both patients had labs ordered by their physicians.The lab slip for Patient 1 was reviewed on July 23, 2013. The lab slip contained the following PHI:1. Name;2. DOB;3. Address;4. Telephone number;5. Account number;6. MRN;7. SSN;8. Diagnoses;9. Date of service;10. Labs ordered; and11. Insurance information, including eligibility and amount of coverage.The assistant stated the physician did not verify the name when he handed the lab slip to the unintended patient.
