Issue:

Based on interview and record review, the hospital failed to implement a patient's right to confidential treatment of their protected information for one sampled patient (1). Findings:During an interview on 2/20/13 at 8:50 a.m., the Compliance Director stated a possible disclosure of Patient 1's confidential information was brought to her attention.A hospital staff member reported on 11/6/12 Physician A and another physician were discussing Patient 1's upcoming surgery in the surgery staff lounge in the presence of other hospital staff.During an interview at 11:00 a.m., the Director of Medical Affairs stated he had interviewed the physician in question who indicated he was discussing Patient 1's upcoming surgery.During an interview at 11:45 a.m., Licensed Nurse B (LN B) stated on 11/6/12 while she was in the staff lounge she heard two physicians discussing the pro and cons and techniques in preparation for Patient 1's upcoming surgery.LN B stated she reported the incident to the Director of Medical Affairs.Record review on 2/20/13 at 1:00 p.m., of the "Agreement on Confidentiality of Hospital Information" dated 3/20/12 indicated: "I understand and agree that in the performance of my duties as an Authorized User of Community Hospital of the Monterey Peninsula's confidential information and/or network, I must hold in confidence all organizational, aggregate, and patient-specific, clinical,financial ,personal, and management information to which I have access..."
