Issue:
Based on staff interview and record review, the facility failed to maintain the privacy and confidentiality for one patient (Patient A), when an employee inadvertently sent Patient A ' s medical records to the wrong recipient.An interview was conducted on 6/18/12 at 2:00 PM, with the facility ' s Privacy Officer (PO). The PO stated that on 5/30/12, he became aware of a breach incident. The PO stated that an employee inadvertently faxed Patient A ' s medical information to the wrong person. The PO stated that the employee faxed 15 pages of medical records. The PO stated that the breach was identified when the recipient of the fax called the nurse and informed them that information had been faxed to the wrong number. The PO stated that all information was retrieved personally.Record review revealed the personal health information (PHI) disclosed in error included: Patient name Date of Birth Address Physician Description of patient conditionThe PO stated Patient A was notified of the breach occurrence. The PO also stated that the employee involved was educated.
