Issue:

Based on interview and record review, the facility failed to prevent unauthorized access and disclosure of a patient's (Patient 1) medical information when it was given to Patient 2. This failure allowed the unlawful or unauthorized access to Patient 1's medical information. Findings:The California Department of Public Health was notified on 11/8/13 that a, "Breach of Protected Health Information (PHI)", occurred on 10/27/13.During an interview on 11/18/13 at 11 a.m., Administrative Staff A stated that he received notification, on 10/27/13, from Unlicensed Staff C, that they had received a phone call, from Patient 2's Wife, indicating that Patient 2's prescription and discharge information had Patient 1's name on them.Patient 1's PHI included his name, date of birth, medical record number, and account number. Administrative Staff A also stated that it was an error, on the part of Unlicensed Staff B, as he did not verify Patient 2's name before giving out the correct prescription and discharge instructions with Patient 1's name on them.
