Issue:

Based on staff interview, clinical record, and administrative document review the facility failed to keep Protected Health Information (PHI) confidential when Patient 1's 'Condition of Admission' paperwork was given to an unauthorized recipient.This failure resulted in the breach of Patient 1's PHI and possible unauthorized use. Findings:On 7/11/14 at 2:53 p.m., during an interview, the Privacy Officer (PO) stated on 6/12/14, Patients 1 and 2 were in the Outpatient Physical Therapy Department. When Patient 2 was ready to leave, Staff 1 gave Patient 1's paperwork to Patient 2's mother. Staff 1 did not check names or verify she was giving the correct paperwork to the correct patient.On 7/11/14, Patient 1's clinical was reviewed. Patient 1's clinical record contained name, medical record number, and account number.The facility Policy and Procedure titled, "HIPAA General Rules for the Use and Disclosure of PHI" dated 04/18/2012 indicated "III. Guidelines: C. Protecting the Privacy: 1. Protecting the privacy of PHI means that PHI is used or disclosed only for authorized purposes, only the minimum necessary information is used or disclosed for any purpose, and only persons who have been authorized ... may use or disclose PHI."
