Issue:

Based on interview and document review, the hospital failed to prevent unauthorized access to one patient's protected health information (PHI).Findings:In interview on 2/28/12 AT 12:30 P.M., Staff A stated that on 11/11/11, he was notified by Staff B that on 11/7/11, Physician C had forwarded Patient 1's medical record to a local Health and Human Services (HHS) clinic by fax. The clinic returned the fax on 11/7/11 at 2 p.m. with a note that Patient 1 was not an HHS patient, and that the clinic did not provide obstetric and gynecologic services. Staff A confirmed that the original was destroyed.Record review on 2/28/12 demonstrated that Patient 1's breached PHI consisted of age, sex, medical record number, chief complaint, medical history and physical examination report, diagnosis, treatment, service date, and treating physician.Record review on 2/28/12 confirmed that the Department and Patient 1 were notified of the error on 11/14/11, within 5 business days of the event.
