Issue:

Based on interview and record review, the facility failed to prevent unauthorized access and disclosure of Patient 1's protected, confidential health information, when the patient's electronic record was accessed by an employee not assigned to the patient's care. This failure constituted a violation of the patient's right to privacy. Findings: During an interview on 3/04/14 at 3 p.m., Employee A confirmed that the patient's record had been accessed by an employee related to the patient, but without authorization or reason to access the information. Employed A confirmed that the audit trail did reveal that the record had been accessed and that the record contained personal and medical information..The patient was notified that his record had been accessed. The record contained health information in addition to the personal information of the patient.The incident resulted from the staff person's failure to adhere to privacy policies and having the ability to access records of patient's other than those in whose care they are involved. The employee wished to know the medical information for this patient.
