Issue:
Based on interview and record review, the facility failed to prevent unauthorized disclosure of protected health information (PHI) for one patient (Patient 1) when a summary of her medical records was faxed to an unintended home health agency. This failed practice resulted in the potential for physical, emotional, and financial harm to the patient.Findings:During an interview with the facility privacy officer (PO) on June 8, 2015, at 4 p.m., the PO stated the facility discharge planning coordinator (DCP) was setting up home health for a patient who was being discharged from the facility (Patient 2), and instead of faxing the summary of care for Patient 2, the DCP faxed the summary of care for Patient 1.According to the PO, the summary of care that was faxed to the home health agency contained the following PHI for Patient 1:1. Name;2. Address;3. Date of Birth;4. Telephone number;5. Health insurance information;6. Medications currently taking;7. Medical History;8. Diagnoses;9. Current vital signs; and,10. A physical examination.Failure of the DCP to ensure the correct patient's information was being faxed resulted in an unauthorized disclosure of PHI for Patient 1.
