Issue:

Today, 07/10/14, the Privacy Officer (PO) received a report from a secondary source that an employee has exercised her CPRS access/permissions to view/enter notes in Veteran-boyfriends chart as a caregiver. Chart is now sensitive. Additional documentation, pending. Referral of case to Human Resources (HR) for potential conflict of interest. Additional notification and investigation, to ensue.

Outcome:

08/20/14: Supervisor found that staff access was not appropriate to her role. Complaint moved to incident status. Notified Supervisor and VA Police of 2 other possible cases and asked them to advise PO of any potential privacy findings. 09/12/14: Discussed at length with Supervisor. This case is being handled by HR. Advised clinical staff that this case be put on hold for Caregiver status until that issue was decided. Appropriate HR actions pending. Investigation concluded. Ticket closure. 09/19/14: The Incident Resolution Service Team deterrmined that the Veteran will recceive a letter offfering credit protection services. 12/10/14: This ticket was reopened per the PO's request. It will provide authority to request an investigative SPAR to investigate current reports of continuing violation of chart access.
