Issue:

A VA Provider on the locked psychiatric unit reported he misplaced a binder with notes on Veterans. Repeated searches have not located the binder. Update: 10/28/11:The provider was taking notes on his patients so he could enter progress notes into CPRS at a later time. Ten Veterans will be sent a notification letter.11/01/11:An appeal was filed. The DBCT reviewed and denied the appeal. The appeal justification stated that all Veterans on the unit are long term advanced dementia patients and would not be able to comprehend the notification letter. The DBCT's position is that their legal guardian, Power of Attorney, or individual in a similar relationship would comprehend the letter. Notification is still required.

Outcome:

Employee has been counseled by Service Chief and reminded of properly safeguarding information.
