Issue:

Based on interview and record review, the facility failed to ensure Patient A's protected health information (PHI) was not sent with Patient B's PHI to a physician's office. This resulted in the unauthorized disclosure of Patient A's PHI, which created the potential for unauthorized use.Findings:On September 20, 2012, at 12 p.m., an unannounced visit was made to the facility to investigate an allegation of a breach of PHI.In a concurrent interview with the Compliance Officer, he stated a document for Patient A was inadvertently stapled to Patient B's PHI. The PHI for Patient A contained a lab result with Patient A's date of birth, name, and the treating physician. The PHI was sent to a physician's office.The facility policy and procedure titled, "HIPAA (Health Insurance Portability and Accountability Act) Compliance in the Laboratory." was reviewed. The policy indicated, "As hospital employees, all laboratory staff members must abide by the standards set forth by the "facility" Compliance Program...It is the responsibility of all employees to protect our patient's right to privacy and confidentiality..."
