Issue:

Based on interview and record review, the facility failed to prevent the unauthorized disclosure of Patient A's medical information. This failure had the potential to result in misuse of protected health information.Findings:On February 22, 2012, at 11 a.m., an investigation was conducted for an entity reported incident.During an interview with the Director of Health Information Management, (HIM), on February 22, 2012 , 1:30 p.m., the Director stated the facility was notified by an individual about an unintended disclosure of Patient A's laboratory results. The Director stated the facility was notified by an individual that she received Laboratory results with Patient A's label, when she was discharged from the ED. The Director stated the information disclosed to the unintended recipient included Patient A's:Name;Date of Birth;Account Number;Medical record number, and;Laboratory Results. The facility's policy titled "Confidentiality/Privacy," with a last reviewed date of July 2011, was reviewed on March 30, 2012. The policy indicated the facility was committed to make reasonable efforts to protect the privacy of patients' health information. The policy indicated PHI was individually identifiable health information that was transmitted or maintained in any form or medium.
