Issue:

Based on interview and record review, the facility failed to notify the California Department of Public Health (CDPH) of the breach of personal patient health information within the required five business days after the breach was detected. Findings:Patient 1's consult letter dated 8/6/12 was inadvertently faxed to an incorrect healthcare provider on 8/7/12. The consult letter contained Patient 1's name, medical record number, date of birth, detailed medical history, diagnoses, laboratory results and treatment plan. During an interview on 11/1/12 at 9:05 AM, the Licensing and Certification Coordinator (Staff A) stated the breach incident was reported late because the documentation of another L&C Coordinator (Staff B) indicated that it was reported to CDPH by fax but there was no hard copy of the fax notification in Patient 1's complaint file. Review of the report sent to CDPH notifying them of the medical information breach indicated it was faxed on 8/30/12 by the Director of Regulatory Affairs (Staff C). The facility was 16 days late in reporting the information breach within five business days after it was detected.
