Issue:

Based on interview and record review, the facility failed to ensure the PHI (protected health information) of Patient B remained confidential. This failure resulted in the breach (disclosure) of Patient B's PHI to an individual not authorized to receive the information, (Patient A).Findings:An interview was conducted with the facility's Privacy Officer (PO) on April 8, 2013, at 2:50 p.m. The PO stated Patient A signed a surgical consent which was stamped with Patient B's PHI.Patient B's PHI which was disclosed to Patient A reflected Patient B's name, medical record number, date of birth, date of admission, account number, area of the facility which the patient was admitted to and the name of the patient's physician.A review of the facility policy, "Safeguarding Protected Health Information (Effective Date: November 1, 2011)," was conducted. The policy indicated, "The facility must take reasonable steps to safeguard and protect PHI. The facility must identify and utilize appropriate administrative, physical, and technical safeguards in order to protect PHI from inappropriate and/or unauthorized access, use, and/or disclosures."
