Issue:

Based on interview and record review, the hospital failed to protect the right for confidential medical treatment for one of one sampled patient (1). Findings:On 10/25/12 at 11:15 a.m. during an interview with the privacy officer, she stated on 8/15/12 the hospital was notified by their legal counsel that an employee of the hospital (ST A) had provided her legal representative a copy of a laboratory form belonging to Patient 1. The privacy officer further stated ST A had a pending litigation case against the hospital and therefore used Patient 1's laboratory form to demonstrate a hospital procedure. After an internal investigation the hospital determined ST A had never cared for Patient 1 and accessed Patient 1's medical record without a business related reason to do so.On the above same day and time a review of Patient 1's laboratory form indicated the following patient information was disclosed; patient name, date of service, names of test, account number and medical record number.
