Issue:

Based on interview and record review, the facility failed to ensure the protected health information (PHI) of Patient A remained confidential. The failure led to the disclosure of Patient A's PHI to an unauthorized individual, Patient B.Findings:An interview was conducted on January 24, 2014, at 9:30 a.m., with the Admissions Services Officer (ASO). The ASO stated Patient B went to the Family Care Clinic on December 30, 2013. When Patient B arrived at the clinic, staff noticed that the referral document was stamped with Patient A's PHI.A review of Patient A's PHI was conducted. The PHI reflected Patient A's name, medical record number, and diagnosis.A review of the facility's policy, "Patient privacy, confidentiality, Medical Records, And Access To, or Release or Disclosure Of, Patient Information (revised 03/16/03)," was conducted. The policy indicated, the facility, "Has established and shall maintain appropriate administrative, technical, and physical safeguards to protect the privacy of a patient's medical information. (The facility) and its personnel shall reasonably safeguard confidential medical information from any unauthorized access or unlawful access, use, or disclosure."
