Issue:

Based on interview and record review, the hospital failed to ensure that Patient 1 and Patient 2's protected health information (PHI) were kept confidential from anyone not directly involved with the patient's care.Findings:An interview with the Health Information Manager (HIM) was conducted on 12/22/11 at 1:50 P.M. According to the HIM, a clinic where both Patient 1 and Patient 2 went to requested both of the patient's medical records. The clinic had multiple sites and the requesting clinic was in location A. The HIM stated that a hospital medical records staff inadvertently faxed both patients' medical records to clinic location B instead of A. A review of the fax transaction report, the medical records that were inadvertently faxed included History and Physical, Emergency Room notes, Radiology and Laboratory reports. An interview with the facility Privacy Officer (PO) was conducted on 12/22/11, at 2:10 P.M. The PO stated that the medical records that were inadvertently faxed to the wrong clinic location, had the patient's name, date of birth, home address, diagnosis, medications, radiology and laboratory results.
