Issue:

Based on interview and record review, the facility failed to maintain the privacy and confidentiality for one patient (Patient A), when an employee inadvertently burned another patient ' s x-ray film unto to compact disc (CD).Findings:An interview was conducted on 3/26/12 at 1:00 PM, with the facility Health Information Officer (HFO). The HFO stated that on 12/30/11, Patient A had a radiology exam completed and images were burned unto a CD. The HFO stated that the breach was identified when Patient A disputed additional radiology fees. The HFO stated that Patient A had discovered at her primary physician ' s visit on 1/6/12 that the images burned to her CD on 12/30/11 belonged to another patient.The facility ' s HFO further stated that the first time the images on the CD for Patient A were reviewed were on 1/6/12 at the primary physician ' s office.Review on 3/26/12 of the CD information for Patient A contained the following personal health information (PHI). Patient name Six radiology images Date of exam Type of examThe HFO further stated that the employee who burned the images failed to verify that the correct images were put onto the correct patient CD. The HFO stated that the patient whose images were burned onto Patient A ' s CD by mistake was notified.
