Issue:

A VA Employee was arrested by non-VA Police who located patient names and medications in paper format but did not conform they were from VA. The papers are impounded in the employee's car. Update: 03/18/13: The event has been reported to the OIG who will be going to the vehicle to review the papers reported that could possibly VA patient medical records since they were a VA employee, Pharmacist. The PO spoke to the VA Police Captain today, she will inform the PO of the OIG's findings once they check the car to determine if VA records are involved. 04/03/13: The employee had 8 VA patients' information in the car. The patients will be sent offers of credit protection services. 04/09/13: After further review, the labels only contained name and medication, so credit monitoring will not be required. HIPPA notiifciation letters will be sent. 05/22/13: This was determined to be HITECH reportable by VHA Privacy Office.

Outcome:

The credit monitoring letters have been sent to the Veterans. The employee has been notified not to remove any information from the facility. A police report was filed. The Chief of Pharmacy will take further action.
