Issue:
Based on interview and record review, the facility failed to ensure facility staffprovided respectful care, by not taking a photograph of Patient A. Patient A was an infant born with deformities. This failure could affect the dignity and psycho-social aspects of the family.Findings:On November 9, 2011, at 12:35 p.m., an unannounced visit was made to the facility to investigate a violation of patient ' s rights.On November 9, 2011, the Nurse Manager for the Pediatric/Neonatal Intensive Care Unit (NICU), was interviewed. The Manager stated on October 19, 2011, Nurse Practitioner 1 (NP) was speaking to the Manager concerning the death of Patient A. NP 1 stated Nurse A had taken a picture of Patient A in the NICU.The Manager stated Nurse A informed her she took the picture of Patient A for educational purposes. The Manager stated Patient A had a graphic birth anomaly.On November 9, 2011, the record for Patient A, was reviewed. Patient A was admitted to the facility on October 16, 2011 with diagnoses that included anencephaly (absence of a portion of the brain). The document titled, " Certificate of Death " , was reviewed. The Certificate revealed, " ...Cardiopulmonary Arrest (heart stopped beating)...Severe congenital brain malformation (brain not formed during the birth process). " Further record review of the document titled, " Consultation Form, " revealed R (right) digit (finger) amputation...L (left) eye not present...No nose...Cleft lip & palate (deformity of lip and mouth)... " On November 9, 2011, the facility policy and procedure titled, " Taping (Audio or video) or Photography (Still motion), " was reviewed. The policy revealed, " ...Photographing or taping (video/audio) a patient anywhere within the Moreno Valley or Arlington campus without the patient ' s written consent constitutes a violation of the patient ' s privacy rights... "
