Issue:

Based on interview, the facility failed to protect the health information for 1 sampled patient (Patient A) as required per Health and Safety Code Regulation 1280.15. As a result, the patient's rights were compromised.Findings:The facility was made aware of a breach of patient medical information on February 18, 2014 and notified the Department of the incident on February 20, 2014.When a patient (Patient B) was discharged from the hospital the medication for another patient (Patient A) was inappropriately sent home with Patient B. When Patient B arrived home the error was discovered and the medication was sent back to the hospital via Fed Ex. A hospital pharmacist inspected the medication and found it was intact and had not been tampered with.Administrative staff confirmed the incident during a telephone interview on February 25, 2014 at 12:03 PM. Administrative staff stated that the nurse who discharged Patient B home from the facility inappropriately placed medications for Patient A in the bag of medications that was sent home with Patient B. When Patient B arrived home the error was discovered and the medication was sent back to the hospital by Fed Ex and a hospital pharmacist verified that the medication had not been opened or tampered with.
