Issue:

Based on interview and record review, the facility failed to notify the California Department of Public Health (CDPH) of the breach of personal patient health information within the required five business days after discovery.Findings:During an interview on 4/1/14 at 9:00 AM, the Privacy Officer stated the facility's electronic health record system had an automated mailing system and was automatically generated once the radiology report was finalized. Privacy Officer stated the radiology report will be sent to the active provider on the computer system. Privacy Officer stated the wrong recipient was not deactivated on the computer system so the wrong provider received the radiology report in error.During an interview on 4/1/14 at 9:10 AM, the Privacy Officer and the Accreditation and Licensing Manager stated the facility was made aware of the breach on 1/2/14 but was not reported to the Department until 1/27/14, which made the reporting late and also late in notifying the patient on 1/24/14. Review of the Radiology Report dated 12/18/13 indicated patient's name, medical record number, date of birth and medical information of the patient. The facility was eighteen (18) days late in reporting to the Department of the breach of medical information.A fax letter dated 1/27/14 reporting Patient 1's medical information breach was received by the California Department of Public Health on 1/27/14.The facility was eighteen (18) days late in reporting the medical information breach to CDPH.
