Issue:
An impermissible access of an employee's medical record has been reported. The employee has retained an attorney. A letter from the attorney was received. The attorney is requesting to be informed of what action was taken to resolve the incident. The attorney was referred to Regional Counsel. Update: 05/02/12:The employee will be sent a letter offering credit protection services as the PII/PHI was accessed without authorization and outside of the scope of duties of the employees that inappropriately accessed the information.
Outcome:
Employees who inappropriately accessed the Veteran's record read and signed the VA Rules of Behavior. Employees were issued formal disciplinary actions.
