Issue:
Based on interview and record review, the facility failed to ensure a printed prescription for Patient A was not given to Patient B's family. The prescription (Rx) was given to the wrong patient. This failure resulted in the unauthorized disclosure of Patient A's protected health information (PHI), which created the potential for unauthorized use.Findings;On October 27, 2011, at 1:30 p.m., an unannounced visit was made to the facility to investigate a breach of Patient A's PHI.In a concurrent interview with the Compliance Officer, he stated the Rx was taken off the printer and the Rx for Patient A was given to Patient B's family. The Rx contained Patient A's name, address, and the Rx medication name.The facility policy and procedure titled, "Admission, Transfer and Discharge for the Emergency Department," was reviewed. The policy indicated, "...Discharge criteria:...The treating physician will bear the responsibility for generating the discharge instruction including prescriptions...The Registered Nurse is responsible for printing the discharge instructions and interpreting the instructions verbally to the patient..."
